Effective Date: 16 October 2026
Last Updated: 16 October 2026

Welcome to HostGraber.in, an online storefront operated by Sharspire Private Limited, under the brand name HostGraber.

These Terms of Service ("Terms" or "Agreement") govern your access to, purchase of, and use of the digital hosting, cloud, and infrastructure services available through https://hostgraber.in.

By placing an order, creating a customer account, or using our services, you agree to these Terms, our Privacy Policy, our Payment, Billing & Refund Policy, and any additional terms expressly applicable to your selected product.

Please read these Terms carefully before purchasing.

1. About HostGraber

HostGraber is a hosting, cloud, and digital infrastructure brand operated by Sharspire Private Limited, based in Kolkata, India.

HostGraber.in provides customers with a convenient way to explore, compare, and purchase eligible digital infrastructure services.

The products available through this storefront may include:

  • Web Hosting

  • Linux VPS Hosting

  • Cloud Hosting

  • Tally on Cloud

  • Other eligible digital hosting and infrastructure services

All services are delivered digitally. No physical shipment is associated with purchases made through this storefront.

2. Eligibility and Customer Responsibilities

By purchasing or using our services, you represent that:

  • You are legally capable of entering into a binding agreement.

  • The information you provide is accurate and complete.

  • You are authorised to act on behalf of any business or organisation for which you place an order.

  • You will use the services in compliance with applicable laws and regulations.

  • You will maintain the confidentiality of your account credentials.

  • You will comply with these Terms and all applicable service policies.

Customers are responsible for maintaining accurate contact and billing information throughout their service period.

3. Orders and Acceptance

Product descriptions, features, pricing, and billing options are displayed on the relevant product pages.

Placing an order constitutes an offer to purchase the selected service.

An order is subject to successful payment confirmation, service availability, and any applicable verification requirements.

HostGraber may decline or cancel an order for legitimate reasons, including suspected fraud, inaccurate customer information, service unavailability, or legal restrictions.

If an order is cancelled by HostGraber before fulfilment, eligible payments will be refunded in accordance with applicable law and our Payment, Billing & Refund Policy.

Order confirmations and related communications will be sent through the registered contact details.

4. Service Activation and Delivery

Services are provided digitally following successful order acceptance and completion of any applicable verification.

Customers will receive relevant service access information or instructions through authorised communication channels.

Activation timelines may vary according to the selected product, service availability, configuration requirements, and security checks.

HostGraber will make commercially reasonable efforts to fulfil accepted orders promptly.

If additional information is needed to complete an order, customers will be informed through the appropriate communication channel.

5. Service Plans and Resource Allocations

Each hosting or cloud plan includes the resources, features, and limitations described on its product page at the time of purchase.

These may include storage, memory, processing capacity, bandwidth, operating-system options, and other relevant service characteristics.

Customers must select a plan appropriate for their intended workload.

Resources may be subject to fair-use rules, acceptable-use requirements, and the limits specified in the purchased plan.

Where an upgrade or additional capacity is necessary, the customer may be offered suitable options subject to availability and applicable charges.

6. Acceptable Use Policy

HostGraber services must be used for lawful and authorised activities.

The following activities are prohibited:

  • Phishing, identity theft, financial fraud, or deceptive activities.

  • Distribution of malware, ransomware, viruses, or malicious software.

  • Unauthorised access to computer systems, networks, or accounts.

  • Denial-of-service attacks or activities intended to disrupt other systems.

  • Sending unsolicited bulk messages or spam.

  • Hosting or distributing illegal or exploitative content.

  • Distribution of pirated software or copyrighted material without authorisation.

  • Operating illegal gambling, fraudulent investment, or other unlawful schemes.

  • Hosting content involving child sexual abuse or exploitation.

  • Using services to facilitate trafficking, exploitation, or other criminal activities.

  • Unauthorised cryptocurrency mining or resource-intensive activity contrary to the purchased plan.

  • Any activity that adversely affects the security, stability, or lawful operation of HostGraber infrastructure.

Security testing involving systems not owned or authorised by the customer is prohibited without the appropriate permission.

HostGraber may investigate suspected violations and take proportionate protective action, including service restriction, suspension, or termination.

Serious security threats or unlawful activities may require immediate action without advance notice.

7. Web Hosting Usage

Web Hosting plans are intended for legitimate website and application hosting.

Customers must use their allocated resources responsibly and within the limits of their purchased plan.

Shared hosting services must not be used primarily as general-purpose file archives, bulk backup repositories, or unrelated storage platforms unless expressly permitted.

Where a product describes a resource as unlimited, that description refers to usage within the product's applicable fair-use conditions rather than unrestricted or infinite capacity.

HostGraber may contact customers whose resource consumption materially affects service stability and may recommend suitable upgrades or corrective measures.

8. VPS and Cloud Hosting

Customers using Linux VPS or Cloud Hosting are responsible for managing their applications, content, credentials, and configurations to the extent specified by their purchased service.

Customers must:

  • Maintain secure authentication credentials.

  • Apply appropriate security updates.

  • Use only authorised software and applications.

  • Monitor their resource consumption.

  • Maintain independent backups.

  • Prevent their services from being used for abusive or unlawful purposes.

Unless expressly included in the selected plan, specialised configuration, application troubleshooting, security hardening, and other additional assistance may be subject to separate service terms or charges.

HostGraber remains responsible for obligations expressly included in the purchased service agreement.

9. Tally on Cloud Services

Tally on Cloud provides eligible customers with remote access to computing infrastructure suitable for their authorised business software usage.

Customers are responsible for maintaining valid licences for applications where licensing is not expressly included in the purchased service.

Customers must ensure that their business information, accounting records, credentials, and software usage comply with applicable laws and licensing terms.

Service accessibility may depend on the customer's internet connection, device compatibility, software configuration, and other external factors.

HostGraber does not provide accounting, taxation, legal, or financial advice through the hosting service.

Customers should independently verify important business records and maintain appropriate backups.

10. Account Security

Customers are responsible for safeguarding their account credentials and access information.

HostGraber recommends the use of strong passwords and available additional authentication safeguards.

Customers must notify HostGraber promptly if they suspect unauthorised access to their account or purchased service.

HostGraber may temporarily restrict access where reasonably necessary to investigate or contain suspected account compromise, fraud, or security threats.

Customers must cooperate with reasonable security verification procedures.

11. Identity Verification and Fraud Prevention

To protect customers, infrastructure, and payment systems, HostGraber may request identity or business verification before or during the service relationship.

Verification may include:

  • Confirmation of contact information.

  • Government-issued identification where reasonably necessary and legally permitted.

  • Business registration or ownership information.

  • Billing and payment verification.

  • Other information proportionate to a legitimate security or regulatory requirement.

Where verification is requested, customers should provide the required information within 72 hours or within another period communicated by HostGraber.

Failure to complete necessary verification may result in a service restriction or suspension.

If required verification remains incomplete for seven days after the request, HostGraber may terminate the affected service, subject to applicable law, proportionality, and any mandatory customer rights.

Where fraudulent or materially false information is identified, appropriate action may be taken to prevent further misuse.

Any refund consequences will be determined according to the circumstances, applicable policy, and law.

12. Pricing and Payment Terms

All services are generally offered on a prepaid basis.

Customers must pay the applicable charges before the relevant service period begins.

Billing periods may include monthly, quarterly, semi-annual, annual, biennial, or triennial options, depending on the selected product.

Prices and available billing periods will be displayed at checkout.

Applicable taxes and additional charges will be disclosed as required by law before payment.

HostGraber may introduce promotional pricing, discount codes, or special offers.

Promotions are subject to their stated eligibility, duration, and redemption conditions.

For complete payment and billing conditions, please refer to our Payment, Billing & Refund Policy.

13. Renewals and Service Continuity

Customers are responsible for ensuring that services are renewed before their applicable expiry dates.

Where automatic renewal is available and authorised, recurring charges may be collected according to the agreed payment arrangement.

Where automatic renewal is not active, renewal payment must be completed before the due date.

Renewal pricing may differ from introductory or promotional rates.

HostGraber may provide renewal reminders through registered contact channels; however, customers remain responsible for monitoring their renewal dates.

Failure to renew may result in service suspension or termination under the applicable service terms.

14. Late Payments and Suspension

HostGraber may suspend a service when an invoice remains unpaid after its due date.

Under HostGraber's standard enforcement schedule:

  • A service may be suspended 24 hours after the payment due date.

  • A final reminder may be issued 48 hours after suspension.

  • A service may be terminated 72 hours after the original due date.

Applicable grace periods, service-specific conditions, and mandatory legal requirements take precedence where relevant.

Late payment charges or reactivation fees may apply where expressly disclosed and legally permitted.

Customers should maintain current backups and renew services before expiry to avoid interruption or data loss.

15. Service Suspension and Termination

HostGraber may restrict, suspend, or terminate a service for legitimate reasons, including:

  • Non-payment or failure to renew.

  • Serious or repeated violations of these Terms.

  • Illegal, fraudulent, or abusive activities.

  • Security threats or compromised accounts.

  • Failure to complete necessary identity verification.

  • Misuse of infrastructure or excessive resource consumption outside permitted limits.

  • Customer-requested cancellation.

  • Other circumstances expressly permitted by applicable law or service agreements.

Where practical and appropriate, HostGraber may provide notice and an opportunity to resolve the issue.

Immediate restrictions may be necessary to protect customers, systems, infrastructure, or legal interests.

Termination may permanently remove access to the affected service and may result in deletion of associated data.

16. Customer Data and Backup Responsibility

Customers are responsible for maintaining current and independent backups of important information stored through their services.

This includes websites, application data, databases, files, email, accounting records, and configuration information.

Unless expressly stated in the purchased service agreement, HostGraber does not guarantee that backups will be available, complete, current, or recoverable.

Any included backup feature is subject to the stated scope, schedule, retention periods, and exclusions.

Customers should export important information before cancellation, expiry, or termination.

Following termination, associated service data may be deleted and may no longer be recoverable.

Nothing in these Terms excludes liabilities that cannot lawfully be excluded.

17. Service Availability and Maintenance

HostGraber works to maintain reliable hosting and infrastructure services.

However, service availability may be affected by scheduled maintenance, emergency repairs, network conditions, external dependencies, security incidents, and other operational circumstances.

Where an uptime commitment is expressly included with a product, its measurement, exclusions, and remedies will be governed by the applicable service agreement.

HostGraber does not guarantee uninterrupted or error-free availability unless expressly committed under a specific service-level agreement.

We may perform maintenance where reasonably necessary to preserve security, stability, and service quality.

18. Cancellations

Customers may request cancellation through an authorised HostGraber customer service channel or an available cancellation option in their account.

Cancellation options may include immediate cancellation or cancellation at the end of the current prepaid billing period.

Immediate cancellation may result in loss of access to the service.

End-of-term cancellation normally permits continued use until the expiry of the paid period, subject to the applicable terms.

Customers are responsible for safeguarding their data before cancellation.

Cancellation does not automatically create a right to a refund for unused prepaid service time, except where required by law or expressly provided under the applicable refund terms.

19. Refund Policy

Refund eligibility depends on the purchased service, its applicable conditions, and relevant legal requirements.

VPS, cloud infrastructure, specialised hosted environments, and activated third-party licences are generally non-refundable, except where applicable law or an expressly agreed service guarantee provides otherwise.

Web Hosting refunds, where available, are governed by the specific refund terms applicable to the purchased plan.

If HostGraber cannot fulfil an accepted and paid order, customers may be entitled to an appropriate refund.

Approved refunds are processed in accordance with the Payment, Billing & Refund Policy and applicable statutory deadlines.

20. Payment Disputes and Chargebacks

Customers who identify an incorrect charge or billing issue are encouraged to contact HostGraber so the matter can be investigated.

This does not restrict any lawful right to contact a payment provider, bank, regulator, or competent authority.

HostGraber may investigate transactions associated with suspected fraud, unauthorised payment instruments, or payment abuse.

Where necessary and proportionate, affected services may be restricted during a legitimate security investigation.

A good-faith billing dispute or lawful exercise of consumer rights will not, by itself, constitute fraud.

21. Third-Party Services and Software

Certain HostGraber products may include or support third-party software and services.

Use of those products may be subject to additional licence agreements or provider conditions.

Customers must comply with all applicable software licensing requirements.

Third-party availability, pricing, product functionality, and support conditions may change independently of HostGraber.

Where relevant, these conditions will be communicated in the product description or applicable agreement.

22. Customer Content and Intellectual Property

Customers retain their applicable ownership rights in content, applications, databases, files, and other materials they lawfully upload or operate through their services.

Customers grant HostGraber the limited permissions reasonably necessary to store, transmit, process, and provide those materials as part of the purchased service.

Customers must not upload or distribute material that infringes the rights of other individuals or organisations.

HostGraber's website content, branding, trademarks, designs, documentation, and proprietary materials remain the property of HostGraber or their respective rights holders.

Unauthorised reproduction or commercial use is prohibited.

23. Privacy and Data Protection

HostGraber collects and processes personal information according to its Privacy Policy and applicable data protection laws.

Customer information may be processed to operate the storefront, fulfil orders, communicate service information, provide support, prevent fraud, and comply with legal requirements.

Customers hosting websites or applications that process personal information are responsible for satisfying their own applicable privacy obligations.

Where a separate data processing agreement is required, the relevant arrangement may be established between the parties.

Please refer to the Privacy Policy for additional details.

24. Support and Communications

HostGraber provides customer assistance through its available official support channels.

Support coverage and response commitments may differ according to the selected product or support arrangement.

Customers should provide accurate information when reporting technical or billing issues.

HostGraber may communicate important notices about service status, billing, account security, maintenance, and changes to applicable terms through authorised contact channels.

Marketing communications are subject to the applicable privacy and consent requirements.

25. Limitation of Liability

To the maximum extent permitted by applicable law, HostGraber will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from use of the services, including loss of expected profits or business opportunities, except where liability cannot lawfully be excluded.

For claims arising from a specific purchased service, HostGraber's aggregate contractual liability will ordinarily be limited to the fees paid for that affected service during the 12 months immediately preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be limited, including liabilities arising from fraud, wilful misconduct, or other non-excludable statutory obligations.

Nothing in these Terms limits customers' mandatory rights under applicable consumer protection laws.

26. No Unconditional Warranty

HostGraber provides services in accordance with their published descriptions and any applicable service-level commitments.

Except for express warranties and rights that cannot legally be excluded, we do not provide additional guarantees concerning uninterrupted availability, compatibility with every application, or suitability for every specialised business requirement.

Customers should review plan specifications and confirm that a selected service meets their requirements before purchasing.

27. Force Majeure

HostGraber will not be responsible for a delay or failure to perform an obligation to the extent directly caused by circumstances beyond its reasonable control.

Such circumstances may include natural disasters, widespread power or telecommunications failures, governmental restrictions, civil emergencies, or other extraordinary events.

HostGraber will take commercially reasonable steps to mitigate the effect of such events where practical.

Payment obligations and mandatory legal rights remain subject to applicable law.

28. Indemnification

To the extent permitted by law, customers agree to indemnify HostGraber against third-party claims, losses, and reasonable expenses arising directly from their unlawful use of the services, infringement of third-party rights, or material breach of these Terms.

This provision applies only to the extent attributable to the customer's acts or omissions and does not require indemnification for HostGraber's own unlawful conduct.

29. Modifications to Services and Terms

HostGraber may update products, features, pricing, policies, and service conditions to reflect business, security, operational, or legal requirements.

Material changes affecting existing paid service commitments will be communicated where required.

Changes to these Terms will be published with a revised effective or last-updated date.

Existing customer rights and contractual commitments will remain protected as required by applicable law.

30. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, subject to mandatory laws that may apply to customers in other jurisdictions.

The parties are encouraged to resolve concerns through good-faith communication.

Subject to applicable consumer protection laws and mandatory jurisdictional rules, disputes arising under these Terms will be subject to the jurisdiction of the competent courts in Kolkata, West Bengal, India.

Nothing in these Terms prevents a customer from exercising a statutory right to seek relief before an appropriate consumer forum, regulator, or other competent authority.

31. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable by a competent authority, the remaining provisions will continue in effect to the extent legally permitted.

These Terms, together with the applicable product specifications, accepted order terms, Privacy Policy, Payment, Billing & Refund Policy, and any expressly incorporated service agreement, constitute the applicable agreement between HostGraber and the customer.

Where terms conflict, mandatory law takes precedence, followed by any expressly agreed service-specific terms and the relevant general policies.
